WEEKLY TOP 40 CHALLENGE SWEEPSTAKES
OFFICIAL RULES
Sweepstakes Name: WEEKLY TOP 40 CHALLENGE SWEEPSTAKES (the “Contest”). Dees Entertainment, Inc., and Dial-Global, Inc., its subsidiaries and affiliated companies (together, the “Company”), will conduct the Contest substantially as described in these rules, and by entering, each entrant agrees as follows:
1. NO PURCHASE NECESSARY. A PURCASE WILL NOT INCREASE YOUR CHANCES OF WINNING . Contest begins at 12:01am Pacific Time on January 1, 2008 and concludes at 11:59:59pm Pacific Time on December 31, 2008 . There are three (3) ways to enter: 1) Write your name, address, city, state, zip code, day and evening phone numbers (including area codes) and email address (if any) on a 3" x 5" card or piece of paper and mail it in an envelope with first class postage affixed to: Weekly Top 40 Challenge Sweepstakes, P.O. Box 196, Hollywood, CA, 90028. Mail-in entries are limited to 1 entry per envelope. 2) Access the online entry form at http://www.rick.com and follow all instructions to complete online entry form, including providing your name, address, city, state, zip code, email address, and day and evening phone numbers (including area codes). 3) Write your name, address, city, state, zip code, day and evening phone numbers (including area codes), email address (if any) and sweepstakes title (Weekly Top 40 Challenge Sweepstakes) on an 8 1/2" x 11" sheet of paper and fax it to: (818) 846-0800. Online and fax entries limit to one entry per person or e-mail address per day. Subsequent entries from a person or e-mail address on any single day will not be eligible for prizes. Multiple mailed entries allowed but each entry must be handwritten in ink and mailed separately. Contest winners will be drawn from mailed entries, online entries, and faxed entries. One prize per person/family/household. By entering, entrants acknowledge compliance with the official rules including eligibility requirements. Responsibility for receipt of entry rests solely with the entrant. Proof of mailing does not constitute proof of delivery. The Company, the participating prize sponsor, each participating affiliate radio station, Dees Entertainment, Rick.com, and their affiliated companies (together, the “Participating Sponsors”) will not be responsible for late, lost, misdirected, mutilated or postage-due entries as well as technical or human errors in omission, interruption, deletion, defect, delay in operation or transmission, theft, destruction, unauthorized access to, or alterations of, entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by the Company on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof. The Company is also not responsible for injury or damage to entrant's or any other person's computer or fax machine related to or resulting from faxing, playing or downloading any materials in the Contest. The Company reserves the right to cancel or modify the online portion of the Contest if fraud, technical failures, or any other causes beyond the control of the Company compromise the integrity of the Contest as determined by the Company in their sole discretion. No mechanical reproductions will be accepted with the exception of entries via http://www.rick.com . Entries void if defective, altered, forged, illegible, or received outside authorized channels. All entries and information become property of the Company and will not be returned. All information collected from entrants is being collected by The Company whose privacy policies apply thereto.
2. RANDOM DRAWING: A random drawing will be held on or about each Monday through January 31, 2009 from among all eligible mail-in, online, and faxed entries received by 11:59:59pm Pacific Time each Friday though December 31, 2008. Odds of winning depend upon the number of eligible entries received each week. Weekly winners will be selected from all entries received for the current week. Non winning entries will not be included in any of the following week's drawings. Winner(s) will be notified by telephone and/or mail on or about each Friday through February 8, 2009 . Winner(s) agree to be bound by these official rules and the decisions of the judges. Weekly drawing will be conducted by Dees Entertainment, whose decisions are final and binding on all matters relating to this Contest. By accepting the prize, winner consents to the use of his/her likeness, photograph, name, or voice for advertising and publicity purposes in any and all media worldwide for the Participating Sponsors without additional compensation or notification (except where prohibited by law).
3. GRAND PRIZE: The prize(s) that may be awarded to the eligible winner(s) each week are: One (1) Grand Prize winner will win a prize offered by that week's Participating Prize Sponsor (Approximate Retail Value: $500.00). The Total Approximate Retail Value of the prize each week is $500.00. The Company reserves the right to substitute this prize for an alternate prize of equal or greater value. No transfer, change or cash substitution of the prize is permitted except at the sole discretion of the Company. Other restrictions may apply. All federal, state, and local taxes on the prize are the sole responsibility of prize winner, if applicable.
4. CONDUCT AND DECISIONS: By entering the Contest, entrants agree to be bound by the decisions of Company personnel. Persons who violate any rule, gain unfair advantage in participating in the Contest, or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited. The Company will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Contest and the Company's decisions concerning such disputes shall be final. If the conduct or outcome of the Contest is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Company, the Company reserves the right to terminate this Contest, or make such other decisions regarding the outcome as the Company deems appropriate. All decisions will be made by the Company and are final. ANY ATTEMPT BY AN ENTRANTOR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF THISCONTEST, TELEPHONE SYSTEMS OR WEBSITES, OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, COMPANY RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.
5. CONDITIONS. Entrants release the Participating Prize Sponsor, each participating affiliate radio station, Dees Entertainment, Inc., Dial-Global, Inc., Rick.com, LLC, their respective directors, employees, divisions, affiliates, officers, subsidiaries, agents, advertising agencies and all others associated with the development and execution of the program, from and against any and all liability with respect to or in any way arising from this Contest and the awarding and use/misuse of the prize, including without limitation liability for death, personal injury and/or disability.
6. ELIGIBILITY. The Contest is open to all legal residents of the United States, who are 13 years of age or older. Only one prize per person/family/household. Individuals who have won a prize from Rick Dees or http://www.rick.com within 180 days (6 months) prior to the start date of this Contest are NOT eligible to participate. Employees of the Company, the Contest Participating Sponsors, and their divisions, affiliates, officers, affiliated companies, subsidiaries, agents and advertising agencies, and members of the immediate family (defined as spouse, mother, father, in-laws, grandmother, grandfather, brother, sister, children and grandchildren) or same household of any such persons are not eligible to participate and win. Each winner must submit proof of eligibility and sign the Company's release form to claim the prize. A parent or legal guardian of any participant who is a minor must sign a release on behalf of the minor to be eligible to receive a prize. The Company disclaims any responsibility to notify entrants of any aspect related to the conduct of the Contest. This Contest is void where prohibited or restricted by law, and is subject to all federal, state and local laws and regulations.
7. WINNER: For a copy of the rules, or where required by law, a list of winners, mail a written request with a stamped, self-addressed return envelope to Weekly Top 40 Challenge Sweepstakes Rules/Winner's List, PO Box 196, Los Angeles, CA 90078. Winners list will be available through June 1, 2009. VT residents only may omit return postage. All entries become the property of the Company and will not be returned.
